Ezm5 Digital Inc. ("Ezm5", “we”, “our”, “us”) provides a web application and website that allows users to securely store, organize, and analyze health data. By using Ezm5, you agree to these Terms. If you don’t agree, please do not use our services.

1. Eligibility

You must be at least 18 years old to create an Ezm5 account. By registering, you confirm that you are legally allowed to use the service and are not barred by any applicable laws, including any embargoes or restrictions applicable to services hosted and delivered by companies registered in the United States of America ("USA", "US", "U.S.").

You may use Ezm5 to store information for children or family members under your care. However, you are solely responsible for ensuring that you have the legal authority to collect, share, and manage such data. You must also ensure that your use of this data complies with local privacy and data protection laws applicable in your jurisdiction.

2. User Accounts

To access our services, you must create an account using a valid email and a secure password. You agree to:

• Keep your login credentials confidential,
• Notify us immediately at info@ezm5.com if you suspect unauthorized use of your account.

You are solely responsible for all activity under your account.

3. Acceptable Use

You agree to use Ezm5 only for lawful and intended purposes. You may not:

5. Your Content and Health Data

You retain ownership of the data you upload or input into Ezm5, including personal health information. You grant us permission to process and store your content solely to provide and improve the service.

You also grant us a limited, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely for purposes of delivering the service. This includes the ability to process anonymized or aggregated data for analytical or technical improvements.

You are responsible for ensuring that any data you upload is lawful and authorized, especially if the data pertains to others. If you upload data on behalf of someone else, you must either be their legal guardian or representative, or have obtained their documented consent to store and process their information through Ezm5.

6. Service Availability and Modifications

We strive to keep Ezm5 reliable, but we cannot guarantee uninterrupted or error-free operation. We may update or modify features from time to time and will provide reasonable notice of significant changes.

We reserve the right to suspend or terminate your access to the service if we believe you are violating these Terms or pose a risk to the platform or other users.

7. Medical Disclaimer

Some features of Ezm5 may use artificial intelligence (AI) or beta functionality. These features are provided without guarantees and may contain inaccuracies. Use them at your own discretion.

Ezm5 is not a medical service and does not provide medical advice, diagnosis, or treatment. Any information presented through Ezm5 is for personal organization and tracking only.

Always consult a qualified healthcare provider for medical decisions or concerns. Never disregard professional medical advice based on information from Ezm5.

8. Disclaimers

While we implement appropriate security measures, no system is completely secure. Ezm5 is not liable for unauthorized access, data loss, or breaches resulting from external attacks or user negligence.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement.

We do not guarantee that the platform will meet your expectations or be free of bugs or disruptions.

9. Limitation of Liability

To the fullest extent permitted by law, Ezm5 will not be liable for any indirect, incidental, or consequential damages, including loss of data or profits, arising from your use of the service.

Our total liability to you will not exceed the amount you paid (if any) in the twelve months prior to the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Ezm5, its officers, employees, and affiliates from any claims, damages, or legal costs arising from your violation of these Terms or misuse of the platform.

11. Force Majeure

Ezm5 shall not be held liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, labor disputes, war, terrorism, government actions, power outages, or internet interruptions.

12. Export Control

You agree to comply with all applicable U.S. export and re-export control laws and regulations. You may not use or access the Ezm5 platform if you are located in a country embargoed by the U.S. or listed on U.S. government export control lists.

13. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.

14. Termination

You may stop using Ezm5 at any time and delete your account. We may suspend or terminate your access if you violate these Terms or engage in conduct that compromises security or legality.

Upon termination, your right to use the platform will end, and your data will be handled as described in our Privacy Policy.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

We encourage you to contact us first to resolve any disputes. If informal resolution is not possible, you agree to submit to the exclusive jurisdiction of the courts located in Delaware.

16. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will notify you through the platform or via email. Continued use of Ezm5 after changes go into effect constitutes acceptance of the updated Terms.
